Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you ("you" or "Customer") and Outpost Preparedness LLC, operator of DrewOS ("DrewOS," "we," or "us"). By creating an account or using DrewOS, you agree to these Terms.

If you are accepting these Terms on behalf of a company, you represent that you have authority to bind that company, and "Customer" refers to that company.

2. The service

DrewOS is a software-as-a-service CRM and workflow automation platform powered by AI agents. The service is described on drewos.ai/product and may include integrations with third-party platforms that you choose to connect (e.g., Meta, Google, LinkedIn, X).

3. Account terms

  • You must be at least 18 years old and able to form a binding contract.
  • You are responsible for everything that happens under your account.
  • You must keep your credentials secure and notify us promptly of any unauthorized access.
  • One person or company per account, unless we agree otherwise in writing.

4. Acceptable use

You agree NOT to use DrewOS to:

  • Send unsolicited bulk email (spam) or violate the CAN-SPAM Act, GDPR consent requirements, or any anti-spam law.
  • Send messages that are harassing, defamatory, deceptive, fraudulent, or that infringe intellectual property rights.
  • Scrape or harvest contacts from third-party platforms in violation of those platforms' terms.
  • Post content on connected social platforms that violates those platforms' community guidelines.
  • Resell, sublicense, or white-label the service without our written agreement.
  • Reverse engineer, copy, or build a competing service from the DrewOS interface or APIs.
  • Interfere with the security, integrity, or availability of the service (no probing, scanning, denial-of-service, etc.).

We may suspend or terminate accounts that violate this section, with or without notice depending on severity.

5. Connected platforms

When you connect a third-party platform (Facebook, Instagram, Google, LinkedIn, X, etc.) to DrewOS, you authorize us to access and act on that platform on your behalf within the scopes you grant. You agree that:

  • You comply with each platform's own terms of service.
  • You can revoke our access at any time, either from inside DrewOS or directly on the platform.
  • We are not responsible for outages, policy changes, or content moderation decisions made by those platforms.

6. Your data

You own all data you upload, import, or generate in DrewOS ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to operate the service for you. We will not use Customer Data to train third-party AI models. See our Privacy Policy for how we handle data.

7. Our IP

DrewOS, including the software, agent designs, prompts, models, UI, branding, and documentation, is owned by Outpost Preparedness LLC and is licensed, not sold, to you. These Terms grant you a non-exclusive, non-transferable right to use the service for your internal business purposes during your subscription.

8. Fees and billing

Plan tiers and pricing are published on drewos.ai/pricing. Fees are billed in advance, are non-refundable except where required by law, and may change with 30 days' notice. If you don't pay, we may suspend the service after a reasonable grace period.

9. Termination

You may cancel at any time from inside DrewOS or by emailing drew@drewos.ai. We may suspend or terminate your account for material breach (including violation of §4) or non-payment.

On termination, you can export your data for 30 days, after which we may delete it. See Data Deletion.

10. Disclaimers

DrewOS uses AI to generate content, classify replies, and take actions you configure. AI output can be wrong, incomplete, or occasionally inappropriate. You are responsible for reviewing AI output before publishing it to customers, social platforms, or other recipients. DrewOS provides approval gates for outbound content; using them is on you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnity

You will defend and indemnify us against any third-party claim arising out of your Customer Data, your violation of these Terms, or your use of the service in violation of law or a third-party platform's terms.

13. Governing law and venue

These Terms are governed by the laws of the State of California without regard to its conflict-of-laws rules. Disputes will be resolved exclusively in the state and federal courts located in San Diego County, California, and each party consents to personal jurisdiction there.

14. Changes

We may update these Terms from time to time. If a change is material, we will give you reasonable notice (at least 30 days for most changes) by email or in-app notice. Continued use after the effective date constitutes acceptance.
